Terms & Conditions
1. Scope
These general terms and conditions (hereinafter referred to as “Terms”) are an integral part of the contractual relationship between you and WELL&GUT regarding all services and products (hereinafter “Services”) of WELL&GUT.
The purpose of WELL&GUT is to provide you with support, information and dietetic advice to help you improve your health and wellbeing based on scientific evidence.
WELL&GUT cannot replace the advice of a doctor, or provide medical advice, diagnosis or treatment.
You can book self-pay services of WELL&GUT, which can be covered by Private Health Insurance, by contacting us directly or your treating doctor can refer you to us.
The contract begins with the acceptance of your booking and the completion of the New client agreement form.
You can cancel your contract with WELL&GUT at any time
If WELL&GUT makes the termination of the contract due to important reasons, such as due to incorrect information, WELL&GUT may retain all payments already received.
2. Initial Consultation
An initial consultation will be agreed between the dietitian and the client and you will receive an email confirming this. The dietetic assessment will be undertaken and a treatment plan agreed. The need for further treatment will be communicated and agreed. A written report will be generated and shared with any parties needed (e.g. GP or consultant) with your prior consent if applicable.
3. Review Appointments
Review appointments will be agreed in advance and confirmed via e-mail. A further treatment plan will then be agreed and sent to the client and any other parties as required and with prior consent from the client.
4. Cancellation
Agreed consultations must be cancelled 24 hours in advance.
Cancelling with less than 24hours notice will incur a late cancellation fee of 100% of the cost of the appointment.
We reserve the right to charge 100% of the cost of the appointment, should you fail to attend the appointment without giving notice.
Private health insurance companies will not make payments for cancelled appointments and you will be charged for these costs personally.
5. Fees
Fees will be agreed prior to booking appointments.
If you have private health insurance then, the services of WELL&GUT will be invoiced directly to your health insurance company. An authorisation code from your health insurance provider must be provided prior to commencing treatment.
The following conditions apply to self-payers: WELL&GUT services are invoiced in advance. All invoices are payable prior to the appointment. WELL&GUT can withhold or interrupt its services until payment is received.
The following process will apply in the event of non-payment:
The Dietitian will contact the client to remind them that that payment is overdue.
If an invoice is not paid within 7 days thereafter, the client will receive written notice that therapy is suspended pending payment in full.
If payment is not received in full within 7 days of therapy being suspended, the dietitian reserves the right to refer the matter to a solicitor and to commence legal action.
All prices are exempt from VAT, as health care services are delivered by a registered dietitian. We reserve the right to change prices.
6. Data Protection
If you accept WELL&GUT, Terms and Conditions, you are confirming that our Privacy Policy has been read, understood and accepted.
The dietitian is registered with the Information Commissioner's Office (ICO) as a Data Controller, registration number ZA391790.
All client details, case notes and correspondence will be stored securely and treated confidentially according to General Data Protection Regulations and the Data Protection Act 1988.
Information is stored in accordance with HCPC standards.
Clients of WELL&GUT are obliged to inform us if any of your personal data becomes inaccurate due to changes in your circumstances.
7. Electronic Communication
E-mail is the preferred method of communication but is never 100% secure, with your consent we will send all communication via the e-mail address you provide us with.
8. Limitations of Liability
The services of WELL&GUT do not replace the advice given by your doctor. Please consult with a doctor for any health issues, concerns or circumstances. Do not delay or disregard medical advice based on information from WELL&GUT.
Any changes you make following advice from WELL&GUT are at your own risk. WELL&GUT assumes no responsibility either directly or indirectly for damage, health problems or inconvenience caused by the use or misuse of the information provided by WELL&GUT. You are responsible for any consequences resulting from misstatements.
9. Copyright
Materials of WELL&GUT (e.g. Patient information, worksheets, etc.) are the property of WELL&GUT or have been licensed and are protected in whole or in part by copyright. They may be passed on to third parties only with the written consent of WELL&GUT.
10. Changes and Additions
WELL&GUT reserves the right to amend and supplement the Terms and Conditions at any time.
11. Assignment of Rights
Your claims arising from a contractual relationship with WELL&GUT shall be transferable only with the written consent of WELL&GUT.
12. Applicable Law/Jurisdiction
The contractual relationship between the customer and WELL&GUT is subject exclusively to English law and shall be subject to the exclusive jurisdiction of the courts of England and Wales.
